The certificates of conformity or test reports issued by notified conformity assessment bodies of other countries, based on bilateral agreements on mutual recognition of conformity assessment activities, are recognized. Recognition of certificates of conformity is carried out by issuing a new certificate of conformity by certification bodies accredited by the National Center for Accreditation.
In the process of recognition, the certification body may establish the need for additional tests if the basic requirements in force in the Republic of Moldova do not meet the requirements specified in the certificate of conformity issued by the conformity assessment body of another country.
In the absence of certificates of conformity or a declaration of conformity, the imported products are subject to conformity assessment in accordance with the procedures applicable to such products and provided in the relevant national technical regulations.
According to the Law of the Republic of Moldova dated March 13, 2003 No. 105 “On Protection of Consumer Rights”, only safe products must be supplied to the country's market, which must be accompanied by certificates or declarations of conformity, other documents in accordance with the law, as well as products that meet the established or declared requirements.
The Consumer Protection Law of March 13, 2003 No. 105-XV prescribes that product information must contain all the information necessary to help the consumer make an informed decision when purchasing products.
The labeling of imported goods must contain the following information:
- name and address of the importer;
- product name, including trade name (if any);
- name and address of the manufacturer;
- net weight of products (metric system);
- the date of production, packaging and import of products.
According to the Law of 09/01/1989 No. 3465 "On the Functioning of Languages on the Territory of Moldova" the names of goods, labels (tags) of goods, markings, instructions for goods, as well as any visual information, are drawn up in the Moldovan (state) and Russian languages.
Requirements for food labeling, presentation and advertising and food labeling are set out in government decisions, which are mandatory.
The National Food Safety Authority (NFSA) is responsible for establishing and interpreting such Decisions, as well as for most of the food quality regulations for specific categories of consumers.
The Law of 02.07.2010 No. 142 "On Energy Efficiency" regulates activities aimed at reducing energy intensity in the national economy and reducing the negative impact of the energy sector on the environment.
Law of 27.03.2014 no. 44 “On Labeling of Energy Consuming Products” establishes the legal framework for regulating national measures regarding the labeling and standard information on energy consuming products intended for end users, in particular on the consumption of energy consuming products and, as appropriate, other basic resources, as well as additional information.
This law provides a partial transposition of Directive 2010/30 / EC of the European Parliament and of the Council of 19 May 2010 on the indication by labeling and provision of standard product information - information on the consumption of energy-using products of energy and other basic resources, published in the Official Journal of the European Union L 153 dated June 18, 2010.
