In Russia, a new draft change.
On April 04, 2013, the Ministry of Industry and Trade of Russia officially published the draft Resolution, which introduces a number of changes to the Russian Federation No. 982PP, according to which a single list of certification objects (products) subject to declaration, approved and put into effect, food products subject to mandatory certification.
As part of the amendments submitted for public discussion, the new draft law significantly narrows the number of commodity items in the register that fall under the laws of legislation to the list of mandatory food certification, in the form of declaration in the territorial scope of the Russian Federation.
Considering the submitted changes, the following will be excluded from the Unified list:
• packaged in containers - drinking water;
• sugar, bakery industry products;
• pasta;
• purpose for the preparation of the first dishes, the second - food concentrates;
• ice cream;
• from marine mammals, fish - fat food;
• tuber crops, technical - vegetable crops;
• cereals, flour, other food products.
Obligatory certification of food products, as amended by the new list, will be carried out taking into account changes regarding the sections of the meat, microbiological industry, beekeeping, cereals, fodder, and others. Also, the adjustments touched on medicines and chemical and pharmaceutical products.
The expected innovations will acquire legal effect presumably from July 1 of this year, along with the entry into force of the next Technical Regulations of the CU. According to the draft, according to the system of mandatory certification, the period of validity of declarations of conformity issued prior to the designated period, as well as the procedure for manufacturing, issuing to circulation on these documents, products are established by the decisions of the CCC and the ECE Council. At the same time, the labeling procedure and the packaging requirements of the relevant food products remain unchanged. That is, remarking a mark of conformity is not required.
Food Certification: Legal Aspects
Food certification in Russia is a procedure for certifying their quality compliance with the requirements and standards established by law. It can be carried out voluntarily or compulsorily, when required by the norms of Russian legislation.
Since 2009, the mandatory certification has been officially abolished. For food products, a declaration of conformity has been established. By the way, both the resolution documents (declaration and certificate) have equal legal force, and the declaration procedure itself is not much different from certification. The main difference between the two is responsibility. Thus, during certification, it is imposed on the expert who conducted the tests of products, and when declaring the manufacturer independently reports that his product meets the established standards, and the certification body only certifies it. In this case, the responsibility lies with the applicant.
